Ekona Posted November 7, 2008 Share Posted November 7, 2008 one of the lads on the MR2ROC got what can be compared to as an ASBO for going a little sideways (apparently) on a roundabout. and for having a noisey car. i think he was banned from driving through certain parts of town after a certain time. have to check with Ekona, as he knows stu well. but the situation was very laughable. and we got him an ASBO T-shirt for meets. Heh, forgot about that! Yeah, I think he got the faux-ASBO as the cops felt he was showboating round the roundabout (which he wasn't according to him, and knowing him he'd happily admit it if it was true so I tend to believe him) as the back end came out a little bit. Given that he was putting 270whp through a mid-engined car weighing a ton at the time, you can see why he was a bit pi**ed. Don't think he was banned from anywhere though, think it was more a case of "If we catch you again son..." he'd have had another warning and been prosecuted under some obscure driving law. Cara Posted November 9, 2008 Share Posted November 9, 2008 I'm pretty sure that there is no legally binding decibel limit for exhaust noise (at least in Scotland), but as with everything else, it is a case for common sense..... for example don't go steaming through a residential area repeatedly at 1am..... there could be repercussions in terms of public nuisance/breach of the peace etc..... As much as it may sting if you ARE stopped, stay as respectful and obliging as possible, no matter what attitude you are faced with. Sad but true, a lot of it is to do with power trips, and the worst thing to do is try to assert yourself - better to just put on the 'yes officer, you are quite right' act! It would have to be absolutely mental to fail an MOT, or u'd have to have a stupid tester. When my Integra used to go for its mot, they drive it in and do the emissions test, and you could barely hear each other inside the building without shouting, and they still passed it straight through! [HL5603] 21 Oct 2008 : Column WA101 The Minister of State, Department for Transport (Lord Adonis): European-Union-type approval legislation in relation to vehicle noise is primarily concerned with ensuring that new vehicles meet specified noise limits and exhaust standards before they are permitted to enter into service. Mandatory EU-type approval requirements have been transposed into UK regulations. Control of vehicle noise in service is governed by domestic legislation. Under regulation 54 of the Road Vehicles (Construction and Use) Regulations 1986, as amended, alteration of the exhaust system of a vehicle so as to increase the noise made by the escape of exhaust gases is an offence. The regulation forbids both the alteration of the silencer itself so as to make the vehicle noisier and the alteration of the exhaust system (by, for instance, replacing the silencer with one of a different pattern) so as to make the vehicle noisier. At MoT, test vehicle testers are required to fail vehicle which are excessively noisy for their type. Enforcement on public roads is carried out by the police, who are able to take action if they suspect a vehicle contravenes construction and use noise, or other, requirements. They have further powers to address noise nuisance under the Police Reform Act 2002 and the Crime and Disorder Act 1998 under which anti-social behavior orders can be served on the vehicle owner, imposing a ban from certain roads or even vehicle confiscation. Also, "Sorry officer, I didnt realise that anything was wrong as I have had my car MOT'd and it passed so I thought all was ok" Or..... "? Sorry, am a bit deaf, can you speak up?.... Or....
