Seat versus Tesla, not a good result for either.. UPDATED page 6

I would of had specialist insurance to cover something like a £70k tesla.

 

Insurance is with directline who have specific policy for Teslas. Ours is actually quite cheap compared to a fully loaded one which comes out at £150kish.

Ah I see, sorry. That'll be covered anyway, as it's not GZ's insurance paying out it's the TP's, which means that they'll have to put him back where he was and I believe that generally speaking a car that's less than 6 months old (may even be a year) will always be replaced with a brand-new one. Certainly something as specific as a Tesla will be, any way.

 

Direct line do a 'new for old' replacement on cars under a year old, but no idea how it works for Teslas as the specs of the cars is constantly changing. Our spec is no longer available.

 

Third party will likely want to settle quickly via 'market value' but again with so few Xs on the road, none for sale on the used market and our car been barely 3 months old I have no idea what they are going to offer.

 

In either case both insurance companies will probably inspect the car again independently, so likely at least another week before anything is confirmed.

Not quite sure what you mean? The closet car on the market to ours is been sold at £90k partly due to the weak £ partly due to Tesla prior rises.

 

What exactly do you think I should be happy with, accept a settlement figure that isn't enough to see me back in the same car as before the accident?

 

Seriously if you were in my position what what you want?

A new car, which is what you'll end up with. It doesn't matter what you paid for yours, if prices have risen then that's not your problem, it's the insurance company's. I don't know the spec of the Model Xs but they can't change that dramatically, as it's not like they've suddenly deleted the sports pack or the V8 from the options list ;) What options does yours have that are no longer available?

From this incident ultimately you and your family are ok and not injured, thankfully the Ibiza driver too. In light of the recent events in the UK whereby the absolute worst things imaginable have happen, be humble. What if your car was stolen and there was no third party to claim off? Who would you enjoy taking to court? What if the stolen car had you daughters very first 1st place award for a project, which to your family was irreplaceable what then? find comfort in the knowledge that options are on the table and not dwell over those that aren't.

The guy deserves a new model X as replacement as soon as he can IMO, none of this is of his own doing.

 

I really don't see why he has any obligations to drive anything else.. not a clue why "daughters first place project awards" are being brought into the thread! :lol:.

Really feel for you gangzoom.

From your other threads it's obvious that you felt as passionate about your Tesla as we all feel about our zeds and to see it wiped out by this numpty must be heart wrenching.

Even more so as it is irreplaceable in as such as obtaining an identical replacement immediately.

I often worry about similar happening to my zed.

If written off my 05 DE with factory Aero kit and LMGT4S may only be worth £6-7 k payout but TO ME it would never see me in the car that I've owned from new and cared for lovingly.

In a way it's lucky your car is so new you'd hopefully get a payout to cover a new replacement to as close a spec as originally purchased.

But the waiting is definitely a bummer.

Can you imagine how much worse it would be if it was a few years down the road and the insurance company only wanted to pay out 60% or so!

Sometimes I wish I was like the majority of car owners who merely see their car as a means of transport on par with a rail season ticket. No emotional attachment. No stress.

Anyway....not only do I hope you get back in an equivalent motor to your liking asap but also that the accused gets done for trying to fraudulently claim it was your fault and get done for dangerous driving and karma bites him in the backside in the future and a joyrider drives his car through his "uninsured" house rendering him unable to live in it as it's deemed too dangerous..... unable to afford the repairs.... selling his home for peanuts due to the damage.... being unable to purchase anything even half the size due to rising house prices... trying to get a caravan instead, but getting refused insurance due to the Tesla incident!

Sorry, I've just had a bad week and am experiencing some anger issues :lol:

I worked many locum hours over bank holidays/nights, cancelled things like the gym membership/Sky to afford our Tesla.

 

I'm simply worried the insurance companies may not settle the claim in a manner that will see me back in the same car. I didn't go out on that drive to have a crash, am not seeking to make any personal gains, all I want is to be back in the car I was driving. I guess I'll find out more next week what the options are.

 

As to this 'been humble' stuff, so if someone hacks your bank account and empties out £20k from life savings but your physically not hurt I suppose that's OK than?? Better to be humble in that situation too I suppose, and if the bank shrugs their shoulders and say they cannot do anything thats that than?? Why bother reporting it to the police, or chasing the banks for compensation, its only money at the end of day so lets just be humble.

So what options do Tesla no longer offer on a new X?

 

More how Tesla have changed what options you could order together, and pricing. I had the additional HEPA filter added for £200, but that is no longer a option and only comes as part of the £4.5K premium pack. Our car's colour combination of white on white is no longer available, the only option for white is only metallic white which is a £1.5K option. Pricing of the 6 seater/winter pack/tow pack have all also gone up in price by about 15-20% inaddtion to rise in price of the base car, all this adds up to over £20K difference between our car and any new 'equivalent' spec car.

 

Essentially you simply cannot order our car any more, certainly not at the price point we paid. Personally I don't want a more expensive car or more options, I just want our car back on the road :(.

Winter pack/tow pack is 15k+, what the hell does that consist of?

 

Base price has gone up by about £13K, all the other options by about 20%. To put it simply, if based on todays pricing we wouldn't have ordered the X, it's simply become too expensive. All the decent spec 'used' cars on sale today are even more expensive than new order because demand for good spec cars are higher than supply - roughly 4-6 months wait time for factory orders.

 

Hence I'm not entirely sure how the loss adjustors are going to calculated the 'market value' of our car, as the original invoice amount we paid in March as of today is not enough to even get us into a base car with no options!!!

 

The whole thing is just a mess I cannot wait to sort out, all you guys on the forum know how long I waited for the car, and to be put in my position now where the insurance settlement might not be enough to see me back in any Model X let alone one in our choice of spec because of some idiots actions is frustrating to say the least.

It's not betterment in terms of spec if you get exactly what you had, and the cost is the cost. Imagine if you bought a LaFerrari a couple of years back for £1M, they're now going for £4.5M so that's what they'd have to cough up. Not something I'd lose any sleep over.

 

I appreciate you're upset about losing your dream car, but you're going to get 99% of the exact same car back but newer: Seriously, chill out and just let things happen. These things happen, it's all going to get sorted, it may just take time. Life's too short to sweat stuff like this.

It is not at all the insurance company's problem that you toiled extra to buy a car that was perhaps a touch beyond your comfortable means. I won't judge you for it, I have done it a couple of times as well. And one time I was punished for it. To be honest, the insurance company when faced with a 6 figure claim, are more inclined to believe that the owner is wealthy and will want to settle quickly to get it over with, even if for a small hit. Imagine if they asked the question on the insurance form "Did you work extra nights to afford this car?" "Yes, yes I did." "Ah, well in that case I don't think it's a good idea that we insure you, because if something happens to the car, we'll treat you in accordance with industry norms, whereas what you'll expect is a unicorn that sh1ts money". <please excuse exaggeration for comedic license>

And so you should be, the insurance company - a 'for profit' business, is going to pull out every dirty trick and excuse under the sun to low ball you and give you less than your car is worth. You should expect this, and to a point, for your own well being, you should choose CAREFULLY when to fight and when to STOP fighting. I don't agree with others here saying that specs not being available is going to be their problem, it's going to be YOUR problem. They know that they can offer you spec B instead of spec A because it has 80% of what you want, and their industry watchdog won't crap on the because of that (all they care about, after their bottom line), and they know that you'll have to take them to court (where you might lose as well), in order to get something better, something that most people wouldn't be prepared to do.

 

 

When my BMW was stolen I was like you, I thought "Whew, no probs, at least my car is clearly worth more than the insured value, I won't have any problems', WRONG. They offered me less than half the value and took a year to settle. It was easier for them to try to shaft me in that case as it was an older car and more debatable the value, but the principle doesn't change, they're a business and they are trying to give you as little as possible, and drag it out as long as possible to crush your spirit (and earn interest, the longer they take to pay you, the less the claim has cost them), as would you in their shoes.

 

I lost 10 grand and a year of my life due to that theft (they kept stringing me along with low ball offers, right up until the day before the first court date when they suddenly wanted to discuss it). Eventually, I got an almost acceptable settlement (2/3rd the value, a loss of 10 grand, to get more I would have had to go to court for 3 years plus).

 

Really, I wish you super good luck, but go in expecting PAIN. At least that way, you might end up pleasantly surprised.

I'm not optimistic, I just know my rights and how to get what I need. I managed to get my car repaired rather than written off when a lorry drove into it, which is easier said than done on a 12 year old BMW that had depreciated like a stone.

 

For GZ, this is incredibly straightforward. I wouldn't be concerned at all, and if he wants a hand he only has to ask. :)

A hand will be great in terms of the right things to check and ask them, but at the end of the day, it's not just knowing your rights, it's a matter of how much are you willing to fight for them. I could have taken my insurer to the cleaners, but it would have cost me 3 years of court battle against a company that could have gone down any minute, I know I did the sensible thing and settled for a lot less than I was due. Swings and roundabouts.

Sounds more like you picked the wrong insurer than anything.

 

I didn't pick them, but yes, that's a big part of it. I specifically asked my insurance broker who has never steered me wrong before, which company I should go with for total peace of mind. It was the most expensive quote as well. I was so pi**ed off when I realised (long after the theft, of course) the company was 'traditionally' a good insurer, but was having problems. I was a hair away from suing my broker, but again decided it wouldn't be worth it. She should have known though.

I don't buy new without GAP cover now. Should the worse happen I don't want to be in the position where I could lose tens of thousands.

 

You have to read the small print on GAP, some only cover from 6 months after the purchase. So anything at the 3 month mark and you SOL.

GAP is suppose to be 'back to invoice' isn't it? The point of my situation is even if I get paid the invoice amount that isn't even enough to see me back in a basic spec Model X with no opinions ticked!!
