  8. Sadly people do have a habit of becoming complete gits when it comes to money etc. sounds like the guy is in a bad place which makes it even harder for you. Basically if he doesn't have a tenancy then he'll have squatters rights. Either way you need to serve Section 8 and 21 notices. Then it's a bailiff to remove him from the property (assuming he refuses to quit at any point). Alternatively if he has no tenancy then you could go unofficial and literally sling him out. Personally I wouldn't recommend this route as you can get in trouble for it but it cane a very effective method in 'unofficial tenancy' situations. *waits for Comrade to arrive and explain why lines 1-6 are all incorrect*
  9. Also it does depend how the CAI is set up. Specifically a Cold Air Intake of the average variety only serves to Hoover up warm air from the engine bay instead of the ducted cold air that a standard box will get. Colder air = bigger bang. If you ducted and shielded a CAI properly and had the ECU set up right to fuel correctly then yes you could get a power increase.

  11. Your understanding is wrong. The term is simply that the outstanding balance of the loan becomes payable either on death by the estate of the borrower or on sale by the borrower himself. There is no need for a charge to do that. You need the charge if you want a security for the loan so that your loan gets a priority over all other debts, credit cards etc. It might be undesirable to lend without any security, but OP seems to understand that. Sorry I perhaps didn't explain myself very well. If the OP wants to ensure priority of repayment upon sale of a property and to not risk being ranked behind other chargees or unsecured creditors then he needs to charge the property. Purely only to protect in a negative equity situation.
  12. Thanks mate, i appreciate everyone's comments and yes i know bit naive on my case. But the car was actually up for 5k originally and knocked down to 4700 and i got him down to 4100 by saying ill be there that weekend. A non-runner doesn't change hands for huge amounts less so I really don't think your too badly screwed here. Granted you can't change the clocks to match the new engine mileage but hey ho.

My understanding is that to make it 'legal' in terms of what you are asking (upon sale of property or death......and I assume you mean by death sale of the property again really) you need to register a charge against the property. I can't advice in respect of you securing your debt against the estate itself.....I don't understand enough about that but if you want to SECURE your debt you need to put a charge on the property. Reason I say this is that any number of people or institutions could charge the property between now and death.....if that happens there may be no equity remaining and as such no monies to clear unsecured debts such as your own. Definite one for a solicitor......this isn't as simple as it sounds.

It's a pain though,then hopefully he'd have a car with a solid engine for not much more than buying a good one in the first place as only paid 4k That is true you know. Stick a decent lump in it and you've essentially got to the point that you should have been in at the start which is no major shakes. 2k for a decent, lowish milage lump, supplied/fitted and you'd around the 6k car territory anyway.

  17. Got to be honest I don't think comrade ever sets out to 'help' or 'assist' anyone. He sets out to make sure they ABSOLUTELY understand the facts of the law when they are contemplating a situation. As far as I'm concerned his information has never been anything other then dead on balls accurate. He never said to not go and stuff the guys teeth down his throat......he just pointed out what would happen if he does.

  20. I agree with this to be honest. This whole 'everyone's entitled' bollocks does my head in. I was averagely intelligent and could have got some sort of Micky mouse degree from some dross Uni or other. All it would have created is a huge debt and 3 less years of spaffing my cash on cars! I know some right mongs who've got degrees. Not a one of them doing anything with them. The DUMBEST plank of wood I know left school at 15. He now earns 500 a day as a project manager in financial services and is the single most qualified person I know.

  22. In my position as a trader I suppose some of my legendary wrath has to be surprised but personally I've always found them to be as full of crap as the rest of them. I seem to remember having to tear Olly to pieces a few years back over a load of dross they were trying to spout. That said the line with insurers is that if it's cheap use em. They are ALL absolutely as rubbish as the next when it comes to aftercare so try not to worry.
